Florida gopher tortoise burrows can change the work zone

Gopher tortoise burrows are protected in Florida, so clearing, grading, and construction plans should check the burrow area before work starts.

Gopher tortoises and their burrows are protected by state law. A relocation permit is needed before disturbing burrows or doing construction activity that affects them. Work may avoid that permit path if all development activity stays at least 25 feet from the burrows and tortoises.

This is not just a big-subdivision issue. It can come up with a house pad, driveway, pool, fence, shed, grading, clearing, or equipment staging area. Routine yard care is usually different, as long as it does not collapse burrows or harm tortoises.

Before land clearing starts, walk the work area and take clear photos. If you see burrows, pause the site plan and check FWC’s permit page or an authorized agent. Keep the map, photos, agent notes, and permit answer with the building file so the crew knows where the quiet zone is.
